Terms of service for Gamify

Welcome to Gamify. These Terms of Service ("Terms") govern your access to and use of the Gamify application, website, and related services (collectively, the "Service"), operated by Group With Gamers LLC ("Gamify," "we," "our," or "us").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

You must be at least 13 years old to use Gamify.

If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Service.

You may not use Gamify if you are prohibited from doing so under applicable law.

Gamify is a social gaming platform that allows users to:

• Create profiles
• Publish posts, comments, and replies
• Upload content, including images and videos
• Create, join, and participate in gaming groups
• Coordinate gaming sessions with other users
• Receive and provide feedback after group activities
• Discover players with similar gaming interests
• Receive recommendations and suggestions generated by automated systems

Gamify is a platform for connecting users. We do not organize, supervise, or control gaming sessions, voice chats, Discord servers, or interactions between users.

You are responsible for maintaining the security of your account.

You agree to:

• Provide accurate information
• Keep your login credentials confidential
• Notify us if you believe your account has been compromised
• Be responsible for activity occurring under your account

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms.

You retain ownership of content you create and post on Gamify.

By submitting content to the Service, you grant Group With Gamers LLC a worldwide, non-exclusive, royalty-free license to:

• Host
• Store
• Display
• Reproduce
• Distribute
• Process
• Analyze
• Modify for technical purposes

solely for operating, maintaining, improving, securing, and promoting the Service.

This license ends when your content is deleted, except where retention is necessary for backups, moderation records, legal obligations, security investigations, or dispute resolution.

You agree not to post, upload, share, or distribute content that:

• Is illegal
• Contains threats of violence
• Promotes harassment or bullying
• Contains hate speech
• Promotes discrimination
• Shares personal information without consent
• Contains malware or malicious code
• Violates intellectual property rights
• Facilitates scams or fraud
• Contains sexually exploitative content
• Encourages illegal activity

We may remove content that violates these standards.

Gamify allows users to create and participate in gaming groups.

You understand and agree that:

• Groups are created and managed by users
• Gamify does not guarantee the quality of any group
• Gamify does not verify the identity of users
• Gamify does not guarantee that gaming sessions will occur
• Participation in groups is voluntary
• Interactions with other users are at your own risk

Gamify is not responsible for disputes between users.

Users may choose to share Discord invitations, gamer tags, or other third-party account information.

Gamify does not control and is not responsible for:

• Discord
• Steam
• Xbox Network
• PlayStation Network
• Nintendo services
• Game publisher services
• Third-party websites
• Third-party applications

Your use of third-party services is governed by their own terms and policies.

Gamify may allow users to submit feedback regarding gaming experiences.

Examples may include:

• Helpful Leader
• Patient
• Clear Communication
• Would Group Again

Feedback, trust indicators, badges, and reputation signals represent user opinions and automated calculations.

Gamify does not guarantee the accuracy of feedback and does not endorse any particular user.

Trust indicators are provided for informational purposes only.

Gamify may use automated systems, artificial intelligence, machine learning, and similar technologies to:

• Analyze posts
• Improve recommendations
• Suggest groups
• Identify gaming interests
• Improve matchmaking
• Detect spam
• Detect abuse
• Improve safety
• Enhance platform functionality

Automated systems may be inaccurate.

Recommendations, suggestions, and automated outputs are provided for convenience and should not be relied upon as guarantees.

We reserve the right to:

• Review content
• Remove content
• Restrict visibility
• Suspend accounts
• Terminate accounts
• Limit platform features

when we reasonably believe doing so is necessary to protect users, the Service, or our business.

We are not obligated to monitor all content.

The Service, including its software, branding, logos, designs, features, and content provided by Gamify, are owned by Group With Gamers LLC or its licensors.

You may not:

• Copy
• Reverse engineer
• Redistribute
• Modify
• Sell
• Exploit

any portion of the Service without written permission.

We may modify, suspend, discontinue, or update the Service at any time.

We do not guarantee:

• Continuous availability
• Error-free operation
• Uninterrupted access
• Permanent storage of content

Features may be added, removed, or changed without notice.

We may suspend or terminate your access if:

• You violate these Terms
• You abuse platform features
• You engage in spam
• You harass users
• You create safety risks
• We are required by law

Termination may occur without prior notice.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMIFY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY
• RELIABILITY
• AVAILABILITY

WE DO NOT GUARANTEE THAT USERS WILL FIND GROUPS, RECEIVE RESPONSES, FORM FRIENDSHIPS, COMPLETE GAMING SESSIONS, OR HAVE POSITIVE EXPERIENCES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROUP WITH GAMERS LLC, ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• CONSEQUENTIAL DAMAGES
• LOST PROFITS
• LOST DATA
• BUSINESS INTERRUPTION
• USER DISPUTES
• USER CONDUCT
• THIRD-PARTY ACTIONS
• CONTENT POSTED BY USERS

ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

You agree to defend, indemnify, and hold harmless Group With Gamers LLC from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use of the Service
• Your content
• Your conduct
• Your violation of these Terms
• Your violation of applicable laws

Your use of the Service is also governed by our Privacy Policy.

By using Gamify, you acknowledge that information may be collected, processed, and stored as described in that policy.

These Terms shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict-of-law principles.

Before filing a legal claim, you agree to first contact us and attempt to resolve the dispute informally.

If a dispute cannot be resolved informally, the parties agree that disputes shall be resolved in the state or federal courts located in Texas, unless applicable law requires otherwise.

We may update these Terms from time to time.

Updated versions will be posted within the Service or on our website.

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
